Sir,
I am directed by the Board of Trade to acknowledge the receipt of your letter of the 6th instant (28250/03) in which Mr Secretary Chamberlain requests to be furnished with the views of this Department on the question whether, under the Ordinance Number 10 of 1902,
it is legal to compel the Hong Kong Electric Company to concrete the whole space between the tracks where the distance between the two sets of rails is more than four feet.
In reply, I am to state that the Board are of opinion that the question is to be answered in the negative, as they concur in the interpretation placed on sections 13 and 14 of the Ordinance in the paragraph of our letter.
The five plans enclosed with your letter are herewith returned.
